IBBI issues circular on filing of list of creditors

Insolvency and Bankruptcy Board of India (IBBI) on November 24, 2021 has issued circular on Filing of list of creditors under clause (ca) of sub-regulation (2) of regulation 13 of the IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 to amend circular No. IBBI/CIRP/36/2020 which specify the “IP to file the list of creditors.”

The following amendment has been made: -

• The following column “Identification No.” has been removed from the following forms namely: -

  1.  List of secured financial creditors belonging to any class of creditors.
  2.  List of unsecured financial creditors belonging to any class of creditors.
  3.  List of secured financial creditors (other than financial creditors belonging to any   class of creditors).
  4.  List of unsecured financial creditors (other than financial creditors belonging to   any class of creditors).
  5.  List of operational creditors (Workmen).
  6.  List of operational creditors (Employees).
  7.  List of operational creditors (Government dues).
  8.  List of operational creditors (Other than Workmen and Employees and   Government Dues).
  9.  List of other creditors (Other than financial creditors and operational creditors).

 

The insolvency professionals are directed to file the list of creditors of the respective corporate debtor under liquidation and modification thereof, in the revised format within three days of the preparation of the list or modification thereof.
