Central Motor Vehicles (Nineteenth Amendment) Rules, 2022.

Industry Specific ComplianceThe Ministry of Road and Transport (MoRTH) on November 22, 2022, published the  Central Motor Vehicles (Nineteenth Amendment) Rules, 2022 to further amend the Central Motor Vehicles Rules, 1989. This shall come into effect on November 22, 2022.

The amendments were made as follows: -

•In Rule 115-G which states “Emission of smoke, vapor, etc., from motor vehicles”

(a) in sub-rule (1)-

(i) after the words “other than quadricycles”. the word “armored vehicles” shall be Inserted.

(ii) after the figures, letters, and word “23rd April 2015”, the word “as amended from time to time” shall be inserted.

(b) in sub-rule (3), for the words, brackets, and letters “the International Centre for Automotive Technology (ICAT), Manesar”, the words “an agency designated under rule 126” shall be substituted.

(c) after sub-rule (3), the following sub-rules shall be inserted, namely: -

“(4) Every manufacturer or importer of M2, M3, and N2 vehicle category, except Tippers and armored vehicles, which are type approved under rule 126, with gross vehicle weight between three and a half tonnes (3,500 kilograms) and twelve tonnes (12,000 kilograms), manufactured or imported for sale in India, shall, on and from the 1st day of April 2023, be tested for Constant Speed Fuel Consumption standard and comply with the Fuel consumption target, notified under the Energy Conservation Act, as amended from time to time.

(5) Every manufacturer or importer of M3 and N2 vehicle category, except Tippers and armored vehicles, which are type approved under rule 126, with a gross vehicle weight of twelve tonnes (12,000 kilograms) and above, manufactured or imported for sale in India, shall on and from the 1st day of April 2023, shall be tested for Constant Speed Fuel Consumption standard and comply with the Fuel consumption target, notified under the Energy Conservation Act, 2001 as amended from time to time".

(6) For the purposes of sub-rules (4) and (5), 

(i) the procedure for Conformity of Production for verifying compliance to Constant Speed Fuel Consumption Norms shall be as laid down in AIS: 149, as amended from time to time.

(ii) the agency referred to in sub-rule (3) shall collect, examine and report the data submitted by the vehicle manufacturers annually to the Central Government.
