The Meghalaya Labour Department on June 29, 2020 issues the draft Meghalaya Industrial Employment (Standing Orders) Amendment Rules, 2020 to further amend Meghalaya Industrial Employment (Standing Orders) Rules, 1947.
Following amendments have been made to Meghalaya Industrial Employment (Standing Orders) Rules, 1947:
• Rule 1(2) which specifies the applicability of the act, has been substituted, stating that “They shall apply to all industrial establishments in respect of which the Government of Meghalaya is the appropriate Government”.
• A new Rules 3A has been inserted which specifies the conversion of the post of permanent workman to fixed workman, namely:-
“No employer of an industrial establishment on the date of the commencement of the Meghalaya Industrial Employment (Standing Orders) Amendment Rules, 2020 as fixed term employment thereafter”.
• Rule 4(a) has been substituted which specifies “Application of forms for the certification in standing orders”, stating that an application for certification in Standing Orders shall be made in Form B.
• Rule 4(c) has been inserted which prescribed particulars of workmen.
• Rule 5(iii) which specifies the statements to be submitted with regards to the workforce, the sub-rule has been substituted, stating to submit separate statements of the prescribed particulars of the workmen including the name of the trade union, if any, in respect of each establishment.
• Rule 9(7) which specifies “Memorandum of Appeals” has been substituted.
• Rule 11 has been renumbered as Rules 10 related to “Registers to be maintained”.
Any interested person likely to be affected by these proposed amendments has any objections or suggestions, he or she may send the same to the office of the Labour Commissioner Meghalaya, Horse Shoe Building, Shillong - 793001, Government of Meghalaya, within a period of 30 days from the date of publication of the said draft amendment rules in the Official Gazette of Meghalaya.
