The Puducherry Labour Department on June 9, 2020 has issued a notification for Puducherry Contract Labour (Regulation and Abolition) (Amendment) Rules, 2020 to further amend the Puducherry Contract Labour (Regulation and Abolition) Rules, 1973.
Following amendments are made in the Contract Labour (Regulation and Abolition) Rules, 1973:
• Rule 24(2) which specifies the amount of security deposit to be paid, has been substituted, stating that the amount of security deposit shall be paid by online payment through on-line portal of the Government of Puducherry under the head of Account 8443 Civil Deposits- 116 Deposits under various Central and State Acts Deposits under the Contract Labour (Regulation and Abolition) Act, 1970.
• Rule 38 related to the payment of fees, shall be substituted, namely:
“Unless otherwise provided, in these rules all fees to be paid by online payment, through on-line portal of Government of Puducherry under the relevant head of Account viz 0230- Labour and Employment 106-Fees under the Contract Labour (Regulation and Abolition) Rules, 1973”.
• Rule 74, which specifies the register of contractors shall be substituted, namely:
“Every principle employer shall maintain in respect of each establishment a register of contractors in form XII be maintained in electronic form.
Provided that during inspection the inspector might require the production of books, register and other documents maintained in the electronic form.”
• Rules 75, which specifies the maintenance of registers of the persons employed, shall be substituted, namely
“Every contractor shall maintain in respect of each registered establishment where he employs contract labour a register in Form-XIII, which may be maintained in electronic form.”
• A new rule 80(6) has been inserted which specifies the maintenance of documents and registers in the electronic form, namely,
“All the books, registers and records required to be maintained under the said rules stipulated under the Puducherry Labour Department shall be at the discretion of the employer, may be maintained in the electronic form”.
