class="MsoNormal">The Labour Department of Delhi on November 02, 2020 has issued an advisory in regards with the complaints regarding non-payment of bonus by the contractors have been received from the outsourced worker. Section 10 of the Payment of Bonus Act, 1965 provides for a minimum payment bonus of 8.33% of the basic and dearness allowance to the employee/ workers, which comes out to be roughly one-month salary of an employee/ worker. Accordingly, the bonus shall be credited within 8 months of the close of the accounting year. Further, it is customary to pay bonus for Diwali.
The non-payment of the bonus shall amount to penalty imposed on the contractors under Section 28 of the Payment of Bonus Act, 1965 and Industrial Disputes Act, 1947 which shall amount to land arrears. Further, all principal employers are urged to ensure the disbursement of the bonus to the outsourced employees in the forthcoming Diwali season.
