The Ministry of Civil Aviation on December 17, 2020 has issued the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Amendment Rules, 2020 to further amend the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Rules, 2015.
The following amendments have been made:
• Rule 4 (2), which specifies that trees shall not be planted in the areas of the civil and defence aerodromes, has been inserted, namely:
“No tree shall be planted or grown on any land within the areas specified in Schedule I of the civil and defence aerodromes, as listed in Schedule III to Schedule VII.”
• Rule 8 (2), which specifies the functions of the committee, has been inserted, namely:
“The Standing Advisory Committee on Radio Frequency Allocation shall forward the applications for No Objection Certificate for heights of the buildings/structures to the Airports Authority of India or the Defence Authorities, as the case may be. The final approval shall be issued by the Standing Advisory Committee on Radio Frequency Allocation Secretariat based on the No Objection Certificate issued by the Airports Authority or the Defence Authorities, as the case may be.”
• Rule 9A, which specifies the validity and revalidation of certificate, has been inserted, namely:
“No Objection Certificate issued under rule 5 shall be valid for a period of eight years from the date of issue of such certificate and shall be extended for a maximum period of twelve years from the date of issue of such certificate.”
• Rule 9B, which specifies the accuracy requirement, has been inserted, namely:
“The applicant shall submit the Coordinates of the site in accordance with the World Geodetic System-84 up to 1/10th of a second in the format of DD MM SS.s (Degree Minutes Seconds).”
