Draft amendment in Madhya Pradesh Child Labour (Prohibition and Regulation) Rules, 1993

Labour ComplianceThe Government of Madhya Pradesh on January 11, 2021 has amended the Madhya Pradesh Child Labour (Prohibition and Regulation) Rules, 1993. 

The following amendments have been made: 

• Rule 2A, which specifies the awareness on prohibition of employment of child and adolescents in contravention to Act, has been inserted, namely: 

“the government should try to aware the general public through campaigns and advertisements to prohibit the employment of child and adolescents in certain employments which are in contravention to the Act.”

• Rule 2B, which specifies the child to work in an employment without affecting his education, has been inserted, namely: 

“the child can be employed to help the family with extra income only if the education of the child is not getting affected. The child shall not perform any tasks during the school timings. The child should not be absent from the school continuously for thirty days without an intimation.”

• Rule 2C, which specifies the child to work as an artist, has been inserted, namely: 

“child can work as an artist and shall not work for more than 5 hours a day. There shall be clean surroundings, physical activity, and proper nutrition for the child. The last 20 percent of the income earned by the child shall directly go into the fixed deposit amount of a nationalised bank to be given to the child after attaining majority.”

• Rule 4A, which specifies the hours of work, has been inserted, namely: 

“the child can work overtime only if it compensates the work of hours on weekdays and legal limits are to be followed.”

All the persons likely to be affected from the said draft shall submit their comments or objection within a time period of 60 days from the publishing in the Official Gazette of Madhya Pradesh. The objections shall be received at the labour department of Madhya Pradesh from any person with respect to the said draft.”
