The Mineral Resources Department (Madhya Pradesh) on July 14, 2021 has issued amendment in the Madhya Pradesh Sand (Mining, Transportation, Storage and Trading)Rule, 2019.
The amendments are as followed:
• In rule 21, which specifies Amount received from mineral sand, the following sub-rules have been inserted, namely:
"(7) The amount deposited for Gram Panchayat/Urban Body under the provisions of Rule 11 of Madhya Pradesh Sand Rules, 2018 shall be transferred, in mineral revenue receipt head.
(8) The amount deposited for District Mineral Foundation under the provisions of Rule 11 of Madhya Pradesh Sand Rules, 2018 shall be transferred in mineral revenue receipt head.
(9) The amount deposited under sub-rule (1) and (7) in mineral revenue receipt head shall be utilized in the works mentioned in rule 13 of Madhya Pradesh District Mineral Foundation Rules, 2016.
(10) If in any Gram Panchayat/Urban Body the amount received is more than rupees 25 lacs for those Gram Panchayat/Urban Body, rest amount shall be transferred to the state mineral fund as provided in Madhya Pradesh District Mineral Foundation Rules, 2016.
(11) Distribution and Accounting of the amount deposited as per sub-rule (7) shall be carried out according to the provisions of rule 56 of Madhya Pradesh Minor Mineral Rules, 1996.
(12) The amount deposited in mineral revenue receipt head as per sub-rule (8) shall be transferred to the state mineral fund as provided in Madhya Pradesh District Mineral Foundation Rules, 2016.".
• Rule 27, which specifies Repeal, has been substituted, namely:
"27. Repeal. -
(1) The provisions related to mineral sand contained in Madhya Pradesh Minor Mineral Rules, 1996 and Madhya Pradesh (Prevention of Illegal Mining, Transportation and Storage) Rules, 2006 are repealed to the extent where it transgresses to these rules.
(2) The Madhya Pradesh Sand Rules, 2018 are, hereby repealed."
