The Ministry of Mines on November 2, 2021 has issued the Minerals (Other than Atomic and Hydro Carbons Energy Mineral) Concession (Fourth Amendment) Rules, 2021 to further amend the Minerals (Other than Atomic and Hydro Carbons Energy Mineral) Concession Rules, 2016.
The amendment in the Minerals (Other than Atomic and Hydrocarbons Energy Mineral) Concession Rules, 2016 are as follows: -
• In Rule 2 which specifies “Definition”, the following changes has been made: -
• In Rule 2(1) (b) & (d) which specifies “composite licence” & “mineral concession”, has been omitted.
• In Rule 2(1)(j) which specifies “value of estimated resources”, the following proviso has been inserted: -
“Provided that if for any mineral or mineral grade, the average sale price in respect of the relevant State for any month is not published by the Indian Bureau of Mines, the average sale price for the latest month published for such mineral or mineral grade shall be deemed to be the average sale price for the said month for which average sale price is not published.”
• In Rule 5, 7 & 8 which specifies “Rights of the holder of a reconnaissance permit”, “Rights of a holder of a prospecting licence to obtain a mining lease”, & “Rights under the provisions of clause(c) of sub-section (2) of section 10A”, has been omitted.
• In Rule 9A which specifies “Composite licence and mining lease granted through auction”, has been substituted.
• In Rule 12B which specifies “Manner of Sale of mineral from the captive leases”, has been inserted.
• In Rule 23B which specifies “Mutation of mining lease or composite licence in favour of legal heirs on death of the lessee or licencee”, has been inserted.
• In Rule 54 which specifies “Penalty”, has been substituted.
• In Schedule XI which specifies “Amount of Fine”, has been inserted.
