The Department of Labour, Delhi on November 26, 2021 has issued the Draft Code on Wages (Delhi) Rules, 2021.
The following are the foremost provisions of the code:
• Manner of calculating the minimum rate of wages
• Norms for fixation of minimum rate of wages
• Endeavour shall be made so that the cost-of-living allowance and the cash value of the concession in respect of essential commodities at concession rate shall be computed once before 1st April and then before1st October in every year to revise the dearness allowance payable to the employees on the minimum wages.
• Number of hours of work which shall constitute a normal working day
• An employee shall be allowed a day of rest every week (hereinafter referred to as “the rest day”) which shall ordinarily be Sunday, but the employer may fix any other day of the week as the rest day for any employee or class of employees.
• An employee in an employment works on a shift which extends beyond midnight
• The extent and conditions of fixing house of work in relation to classes of employees mentioned in sub-section (2) of section 13 of the Code.
• The longer wage period for the purposes of minimum rate of wages under section 14 of the Code shall be by the month.
• Timely Payment of Wages.
• The manner of imposing fine under sub-section (1) of section 56
• Manner of holding enquiry under sub-section (1) of section 53
• Form of register, etc.
Any person who is likely to be affected there by and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Part-IV of the Delhi Gazette- Extraordinary. Any objection or suggestion, which may be received by the Additional Secretary (Labour) (HQ) ([email protected]), Government of National Capital Territory of Delhi, 5, Sham Nath, Marg, Delhi- 110054, in writing or on email from any person before the expiry of the period specified above, will be considered by the Labour Department, Government of National Capital Territory of Delhi.
