PESO issues Guidelines for grant of licence in Form XIX (bowsers) under Petroleum Rules, 2002

Commercial ComplianceThe Petroleum and Explosives Safety Organisation (PESO) on March 25, 2022 has issued Guidelines for grant of licence in Form XIX (bowsers) under Petroleum Rules, 2002.

The guidelines are as followed:

• A copy of an agreement made between the owner of bowser (mobile dispenser), Oil Marketing Company (OMC) and occupier of the premises licensed in FORM XIV or FORM XV shall be obtained during grant / amendment of the license Form XIX. The same shall be verified during grant of renewal of license.

• An undertaking stating that "HSD shall be delivered only for onsite refuelling of stationary equipment’s, heavy machinery and heavy vehicles and not for delivering of HSD to two wheelers/ three wheelers / four wheelers/trucks/ buses / tankers, etc and also not to deliver HSD in jerry cans from bowsers" shall be uploaded by the occupier of bowser while submitting documents for grant/ amendment of license.

• During grant / amendment of license, the applicant shall provide details of GPS device installed in the bowser and the same shall be mentioned in drawings. Documentary evidence for purchasing of GPS device shall be made available during grant / amendment of license. The certificate issued under Part II of FORM VIII by a competent person shall contain details such as make, model and function of GPS device installed in the bowser. In this regard, a circular issued to the fabricators and competent persons is enclosed.

• If any complaint is received against any bowser for delivering of HSD other than for onsite refuelling of stationary equipments, heavy machinery, heavy vehicles and delivery of HSD in jerry cans from bowsers, violating Petroleum Rules and conditions of the license, copy of the complaint shall immediately be forwarded to the District Supply Officer of concerned District, Oil Marketing Companies and local police station through email and copy of the same shall be endorsed to District Authority, PESO shall immediately examine the details recorded in GPS to verify the veracity of the complaint and if found true, action may be taken towards suspension / cancellation of the license in accordance with the relevant provisions of the Petroleum Rules, 2002.

• All the Circle and Sub Circle Heads shall conduct meetings via video conference on quarterly basis with the Officials of Oil Marketing Companies, Bowser Owners and District Supply officer to sensitize the matter and also to ensure that refueling is done at the Geo Fenced locations only. A consolidated report shall be submitted to the Chief Controller of Explosives, Nagpur on quarterly basis.

• A licence may be granted with a condition that the licence shall be amended in case the area of operation or type of refuelling vehicles is changed.
