The Labor Department, Rajasthan on June 07, 2022, revised notification no. F. 8 (5) (6) New. m. Abhi. / Shram / IR / 2000 / Part /2846 dated February 02, 2022, was published in Rajasthan Gazette Special Issue Part-1 (B) to change the rates of minimum wages of employees scheduled in unskilled, semi-skilled, skilled, and highly skilled employees.
Few things to be noted-
•The minimum rates of wages payable to an employee receiving daily wages have been calculated by dividing the rate of monthly wages fixed for that class by dividing 26.
•Notwithstanding anything contained herein, if on the date of coming into force of the above rates, the wages of an employee in any of the above employments are more than the above rates, then the actual wages received by him on the said day shall be fixed in respect of him. The minimum rate of wages will be.
•The rates of minimum wages specified in the Schedule shall include subsistence allowance, basic value, and Inclusive of cash value, if any, in lieu of facilities.
•For the employees working in the above employments, the weekly leave shall be provided at the fixed-rate salary is included.
•If an employee is made to work more than the prescribed normal working hours (8 hours per day), the overtime work will be paid at the rate of twice the normal wage rate.
•Wages for persons below the age of 18 (eighteen) and persons with disabilities for the same category (unskilled, semi-skilled, skilled, and highly skilled) shall be payable at par with adult persons.
•Consumer Price Index of industrial workers for Jaipur, Alwar, and Bhilwara centers received from Labor Bureau, Shimla from 01.07.2020 to 30.06.2021 has been included in the notification. The growth of consumer price indices during this period is 171 points.
•If a part-time worker works less than 4 hours, then he will get 50% of the prescribed minimum rate, and full-time if he works more than 4 hours will get a fixed salary.
•The rates of the said wages will be applicable from date 01.07.2021 and to pass any kind of decision in the petition number-8986/2021 pending in Hon'ble Rajasthan High Court, Jaipur, separate review/revision action will be taken as required.
