The Ministry of Home Affairs (MHA) on July 1, 2022 has issued the Foreign Contribution (Regulation) Amendment Rules, 2022 to Foreign Contribution (Regulation) Rules, 2011. This has come into force on July 1, 2022.
The following has been amended namely: -
• Rule 6 which specify “Intimation of receiving foreign contribution from relatives” has been substituted namely: -
“Any person receiving foreign contribution in excess of Ten Lakh rupees or equivalent thereto in a financial year from any of his relatives shall inform the Central Government in Form FC-1 within Three Months from the date of receipt of such contribution.
• Rule 13 which specify “In the event of receipt of foreign contribution in excess of one crore rupees in a financial year” clause (b) has been omitted.
• Rule 20 which specify “Revision” has been substituted namely: -
“An application for revision of an order passed by the competent authority under section 32 of the Act shall be made to the Secretary, Ministry of Home Affairs, Government of India, New Delhi in such form and manner, including in electronic form as may be specified by the Central Government. It shall be accompanied by a fee of Rs. 1000 One Thousand only) in the form of a demand draft or a banker's cheque in favour of the "Pay and Accounts Officer, Ministry of Home Affairs", payable at New Delhi.”
