Industry Specific ComplianceThe Ministry of Civil Aviation on July 6, 2022 has issued Draft Aircraft (……Amendment) Rules, 2022 to further amend the Aircraft Rules, 1937. It shall come into force on the date of its publication in the Official Gazette.

The Following has been amended namely: - 

• Rule 13 which states “Photograph at aerodromes or from aircraft in flight” has been substituted namely: -

“No person shall take, or cause or permit to be taken, at an Aerodrome licensed by the Director-General of Civil Aviation or from an aircraft in flight, any photograph except in accordance with and subject to the terms and conditions of a permission in writing granted by the Director-General, a Joint Director General, a Deputy Director-General or the Director of Regulations and Information of the Directorate General of Civil Aviation.

Provided that the Director-General from time to time, may, by notification in the official Gazette, direct that these restrictions shall not apply to photography at any Aerodrome licensed by the Director-General of Civil Aviation, or within such limits of any Government aerodrome as may be specified in the order.”

• Rule 38 which specify “Licensing Authority” clause (1)(h) has been substituted namely: -

“Flight Instructor’s Rating (for aeroplanes, helicopters)”

• Rule 42 which states “Licences and their renewal” the following Sub-Rules has been inserted namely: -

“1A. The requirements of competency and recency for exercising the privileges of the licence, as prescribed by the Director-General, shall be completed before Instrument rating test and Pilot Proficiency check.

1B. Ensuring compliance of requirements as mentioned above in sub-rule (1A) shall be the responsibility of the Examiner, Operator or individual and such compliance would be verified by the Director-General at the time of renewal of license, ratings, as the case may be.”

Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation or mailed to [email protected] before thirty days from July 6, 2022.
