The Himachal Pradesh State Pollution Control Board (HPSPCB) on July 02, 2022 has issued a corrigendum regarding the clarification in the definition of producers, Importers and brand owners in the Action plan notifies by state government.
The following have been decided and clarified for compliance :
• All "Producers" in the State, as defined under Plastic Waste Management Rules 2019, which supply their manufactured products to "Brand Owners" and do not produce any pre-consumer waste by reusing the waste in their process, such units shall be required to submit only their action plan for plastic waste management as mandated under Rules 9(2) of the Plastic Waste Management Rules, 2016 at time of applying for consent in the prescribed format incorporating the details of Brand Owners to whom the product is being supplied by the unit, which shall not require an endorsement by Secretary, Urban Development, GoHP.
• All "Brand Owners", including online platforms/marketplaces and supermarkets/retail chains, which are micro and small enterprises as per the criteria of Ministry of Micro, Small and Medium Enterprises, Government of India shall be exempted from the above notification.
• Until SOP Extended Producer Responsibility (EPR) Framework of Urban Development Department is notified, all consent applications (CTE/CTO/RCTO) of PIBOs requiring the mandatory submission of action plan under PWM Rules, 2016 be endorsed by Secretary, Urban Development to GoHP shall be processed by HPSPCB on merit subject to the condition that the PIBOs shall submit such endorsed action plan within 8 weeks from the date of notification of SOP EPR Framework by UD Department failing which consent so granted shall be deemed withdrawn and further regulatory action shall be taken.
