Industry Specific ComplianceThe Government of Himachal Pradesh on July 20,202, imposed a ban on the use of plastic carry-bags and certain plastic items having one-time use and also authorized certain officers of different Departments to compound any offense as per provision of section 11 of the Himachal Pradesh Non-Biodegradable Garbage (Control) Act, 1995

Also the government is pleased to direct that no person including shopkeepers, vendors, wholesalers, retailers, hawkers, rehariwala, etc. shall import, stock, distribute, sale and use the following one time use plastic (Single Use Plastic) items including carry bags, thermocol items made of non-biodegradable material as listed in the Schedule appended to the Himachal Pradesh Non-Biodegradable Garbage (Control) Act, 1995.

Any person, institution/commercial establishment (educational institutions, offices, hotels, shops, restaurants, sweetshops; dhabas, religious institutions, industrial establishments, banquet halls, etc.) causing breach of the aforesaid prohibition shall be liable for the penalties as per the provisions contained in the Act ibid.

The Governor, Himachal Pradesh is further pleased to authorize the officers as per the details contained in Annexure-A, to exercise the powers conferred by section 7(A) and Section 11(1) of the Act, in supersession of this Department's notifications referred to in para-1 above, for entry and inspection under section 7(A) and to compound any offense as per provision of section 11 of the Act ibid, while compounding the offenses committed under the Act ibid, shall specify the sum for compounding as per the following criteria mentioned in the document attached.
