Finance & Taxation ComplianceThe Directorate of Commercial Taxes, West Bengal on September 29, 2022 has issued Notification regarding Manner of filing refund of unutilized ITC on account of export of electricity.

The following has been amended namely: -

• Introduced to resolve the issue faced by power generating units in filing of refund of unutilised Input Tax Credit (ITC) on account of export of electricity. Because, though electricity is classified as “goods” in GST, there is no requirement for filing of Shipping Bill/ Bill of Export in respect of the export of electricity.

• The process for filing a refund claim is mentioned in the notification.

• The time period of two years from the relevant date has been specified for filing an application for a refund.

• The process of refund claim by proper officer has been stated in the notification.
