The Information Technology Department, Jammu and Kashmir on February 13, 2023, issued the Jammu & Kashmir Communication & Connectivity Infrastructure Policy (Amendment) Rules, 2023 to further amend The Jammu and Kashmir Communication and Connectivity Infrastructure Policy (JKCCIP), 2020.
The following has been amended namely: -
• Rule 13 which states “Application by a Licensee/Infrastructure Provider before Appropriate Authority” the following has been amended:
1. Under (ii)(g) has been substituted to state: -
“Acknowledgment receipt issued by Licensed Service Area (LSA), J&K, DOT of the self-certificate submitted by the Licensee in respect of mobile tower/Base Transceiver Station (BTS) establishing maintaining, working, repairing, transferring or shifting/certifying that all general public areas around the tower will be within safe Electro Magnetic Radiation (EMR) exposure limit as per peak traffic measurement after the antennas starts radiating.”
2. The following proviso is added after sub-clause (j)
“Provided that the documents mentioned in rule 13-clauses (ii) sub clause (b) (c) (h) (i) & (j) shall not be required in case of application made for establishment of over ground telegraph line”
• In Rule 14 which states “Procedure to be followed by Appropriate Authority for granting approval” clause (iii) has been substituted namely: -
“Where the over ground telegraph line is established over the immovable property, vested in the control or management of any appropriate authority, then in such cases, one time compensation shall be payable for the value of the immovable property, not exceeding one thousand rupees per kilometre of the over ground telegraph line established”
This has come into force on February 13, 2023
