The Government of Madhya Pradesh on February 17, 2023, issued the draft of the Madhya Pradesh Gram Panchayat (Control on Erection and Extension of Building) Rules, 2022.
The following provisions have been stated:
• No person shall erect, re-erect or construct or build any building without obtaining permission of the Gram Panchayat in writing.
• Any person intending to erect, or re-erect a building shall before be beginning to erect, re-erect the same, apply in writing to Gram Panchayat for permission and shall furnish along with the key plan, site plan, building plan, service plan, specifications, certificate of supervision and proof of ownership or any legal right in relation to the site, in quadruplicate.
• On receipt of a report from the building officer, the Gram Panchayat may either sanction or refuse plans and specifications or may sanction them with such modification or directions as it may deem necessary or may direct that work shall not be proceeded with, unless and until all questions connected with the respective location of the building and such street have been decided to its satisfaction and thereupon shall communicate its decision to the applicant.
• The permission once accorded, shall remain valid for up to one year. The permission shall be got revalidated before the expiration of this period. Such revalidation may be permitted for two consecutive terms of one year each, after which proposals shall have to be submitted afresh.
• The Gram Panchayat may revoke any permit issued under the provisions of these rules, wherever there has been any false statement or any misrepresentation of any material fact in the application on which the permission was based.
It is informed to all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on the expiry of 30 days from the date of its publication of this notice in the Madhya Pradesh Gazette.
Any objection or suggestion which may be received from any person with respect to the said draft of rules on or before the expiry of the period specified above at the office of Additional Chief Secretary, Panchayat and Rural Development Department, Mantralay, Vallabh Bhawan, Bhopal shall be considered by the State Government.
