The Ministry of Law and Justice, on April 11, 2023, notified Competition (Amendment) Act, 2023 to further amend the Competition Act, 2002.
The following has been stated-
•Insertion of a new section 6A. Open offers, etc.
•Insertion of new section 29A. Issue of the statement of objections by the Commission and proposal of modifications
•After section 59 of the principal Act, the 59A. Notwithstanding anything contained in the Code of Criminal Procedure, 1973, any offense punishable under this Act, the section shall be inserted.
•After section 64 of the principal Act, the 64A. The Commission shall ensure transparency while making regulations under section 64. and sections shall be inserted. 64B. The Commission may publish guidelines on the provisions of this Act or the rules and regulations made thereunder either on a request made by a person or on its own motion
