The Government of Bihar on April 19, 2023, published the Draft Bihar Municipal Plastic Waste Management (Amendment) Model Bye-laws, 2022
This shall come into force after 30 days from the date of publication of this notification in the official gazette
The following has been stated namely: -
• These Bye-laws shall be applicable to Every Plastic waste generator, manufacturer, producer, importer, brand owner, and user available within the jurisdiction of the urban local body
• It states that these Bye-laws shall not be applicable to the export-oriented units or units in special economic zones notified by the central government and manufacturing their products against an order for export and shall not apply to units engaged in the manufacturing of gutka, tobacco, and pan masalas ad also to any surplus and rejects leftover products and the like.
• It has defined various terminologies such as “Carry bags and commodities”, “Brand owner”,” Foodstuffs”, “Multi-layered Packaging” etc.
• It states that the urban local body shall manage the plastic waste
• It has laid down various conditions that are to be fulfilled.
• It states that the retailers or street vendors shall not sell or provide commodities to the consumer in plastic sheet or multi-layered packaging which are not manufactured, labeled, or marked as per the prescription under these bye-laws.
• It has mentioned provisions pertaining to the Registration of the producer, recyclers, and manufacturer
• The provisions relating to the Collection, segregation, and processing of plastic waste.
• It states that fifteen percent of the user fee collected as per SWM Byelaws by urban local bodies shall be transferred to a plastic waste management account for the purpose of the management of plastic waste
