The Government of Punjab on May 08, 2023, issued a notification regarding the Punjab Liquor License (Third Amendment) Rules, 2023 to further amend the Punjab Liquor License Rules, 1956
These rules shall be deemed to have come into force on and with effect from April 01, 2023, and in the case of L-2 (Airport) from April 15, 2023.
The following has been amended as follows namely: -
• in rule 1, in the Table, given under the heading "I. Foreign Liquor", after Form L-2A, the Form “L-2 (Airport)” shall be inserted, namely: -
“L-2 (Airport) Retail vend of Foreign Liquor (including BIO approval of Excise Brands) Wine and Beer at the Airport for consumption on the premises”
• in Rule 38 which states “The licenses shown in this rule are granted subject to the special conditions noted under each addition to the conditions laid down in Rule 37”
(i) In special condition 1, in clause (d), below the Table, the following note shall be added, namely: -
“Note: Monthly non-refundable security amount for a particular month shall be payable by the 15th day of the same month. If the entire non-refundable security amount for a month is not paid by the 15th day of the same month, a show cause notice for cancellation shall be issued to the licensee with the direction to deposit the due non-refundable security amount by the 25th day of the same month along with interest failing which his license shall be canceled by the Collector-cum- Deputy Commissioner (Excise) with effect from the 26th Day of the same month. Interest shall be chargeable at the rate of 1.5 percent per month to be calculated on a daily basis on delayed payments.";
(ii) after special condition 2-A, the following condition shall be inserted, namely: -
“L-2 (Airport) A license in form L-2 (Airport) for retail vends of foreign liquor (including BIO Brands) Wine and Beer at the Airport for consumption off the premises, -
(a) the license L-2 (Airport) is for retail sale;
(b) this license shall be granted. -
(i) The first right of refusal shall be with the existing licensee;
(ii) in case, the existing licensee does not avail of this opportunity, the contract entered by CHIAL/AAI with the existing licensee for duty paid to shop at the Airport, for five years, shall be terminated. Thereafter, the Airport Authority shall initiate the process of allotment of shops afresh;
(c) the fixed license fee shall be rupees six crore for the Airport at Mohali and rupees four crores for Airport at Amritsar. This Fixed License The fee shall not be calculated on a pro-rata basis. The license shall not be renewable. It shall be granted afresh on a yearly basis.”
