The Ministry of Health and Family Welfare (MoHFW) on May 17, 2023, issued the Draft Cosmetics Rules, (......Amendment) Rules, 2021 to further amend the Cosmetics Rules, 2020
The following has been amended namely: -
• Rule 3 which states “Definitions” the following has been amended: -
1. Clause (m) which states “Laboratory” has been Omitted
2. After Clause (w) which states “Use before” the following has been inserted:
“Explanation: When use before term is used it shall mean use before first day of month stated on label and when date of expiry is used, it means the cosmetic will expire on the last day of the month.”
• Rule 4 which states “Licensing Authorities” Sub-rule 2(ii) has been omitted
• Rule 7 which states “Government Analyst” has been substituted namely: -
“Government Analyst- The Government Analyst for the purpose of these rules shall be as referred in section 20 of the Act and rules made thereunder.”
• Rule 31A which states “Cancellation and suspension of licence” has been inserted
