The Food Safety Standards Authority of India (FSSAI) on May 22, 2023, issued a direction under Section 16 (5) of the Food Safety and Standards Act, 2006 regarding enforcement of the Food Safety and Standards (Labelling and Display) Second Amendment Regulations, 2022.
Reference is drawn to the Food Safety and Standards (Labelling and Display) Second Amendment Regulations, 2022 wherein, SI. No. 1 of the table in sub-paragraph (3) of paragraph (1) in Schedule-II specifies a 'Note' below the declaration for 'Pan Masala' as:
"Note: The warning statement must cover 50% of front-of-pack of the label"
In this context, representation has been received from the association requesting an extension of the aforementioned 'Note' amendment so as to exhaust the packaging material having the existing warning and to arrange for the new packaging material.
It has been decided to defer the enforcement of above mentioned 'Note i.e. "The warning statement must cover 50% of front-of-pack of the label" in Schedule- II of Food Safety and Standards (Labelling and Display) Second Amendment Regulations, 2022 for a period of three months from the date of enforcement i.e. May 01, 2023.
