The Government of Madhya Pradesh on May 26, 2023, issued a notification regarding the amendment to the Madhya Pradesh Sand (Mining, Transportation, Storage, and Trading) Rule, 2019
The following has been amended namely: -
• It states that throughout the rules, for the word “Contractor” wherever it occurs the words “Mine Developer cum Operator (M.D.O)” shall be substituted.
• In Rule 2 which states “Definitions” in the sub-rule (1) after clause (g) the following shall be inserted namely: -
“(g-i) Mine Developer cum Operator (M.D.O) means Mine Developer cum Operator appointed by the Corporation as per the procedure prescribed in rule 8, who shall be authorized to mine and sell sand from the sand mine of the group allotted to him and shall be held responsible to discharge all statutory obligation”
• In Rule 3 which states “Restrictions” the following changes shall be made: -
(1) For the sub-rule (5) the following shall be substituted namely: -
“(5) The sand mining by the M.D.O of the group of the sand mines shall be subject to various statutory permissions”.
(2) For the Sub-rule (6) the following shall be substituted namely: -
“(6) There shall be a complete ban on sand mining, loading, and storage y the machines from the approved sand quarries in Narmada River, sand mining at mines in other rivers shall also be carried out as per the conditions stipulated in the statutory clearances like mining plan, environment clearance, Air water consent, etc.”.
• For Rule 7 which states “Fixation of the preliminary base price (Upset price)” the following Rule should be substituted namely: -
“7. Determination of the Initial base price (Upset price)-
The initial base price (upset price) of the group shall be 250 (in rupees) for the sum total of the available sand quantity (in cubic meters) separately in all the mines included in the tender of the group
Provided that the calculation of the initial base price of the group on the basis of the estimation of the demand of the sand, quantity different from the total of the quantity of all mines can also be determined”
