The Labour Department, Rajasthan on May 23, 2023, published the Draft Rajasthan Industrial Relations Rules, 2023
These Rules shall come into force on the date of their final publication in the Official Gazette.
The following has been stated namely: -
• These Rules shall extend to the whole of the State of Rajasthan with respect to the industrial establishments and matters for which the State Government is the appropriate Government.
• It has defined various terminologies such as “Form”,” Code” and “section” etc.
• It states that The Agreement under clause (zi) of section 2 for a written agreement between the employer and worker shall be in Form-I and shall be signed by the parties to the agreement and a copy thereof shall be sent to the Conciliation Officer concerned.
• It has laid down provisions related to the Bi-Partite Forums and the Manner of choosing members from the employers and the workers for the Grievance Redressal Committee.
• The application, certificate, and manner of payment for the registration of the trade unions have been incorporated.
• It has stated the conditions for the Withdrawal or Cancelation of Registration.
• The Mechanism for the Resolution of Industrial Disputes has been stated.
• It has mentioned the provisions related to the Strikes, Lock-Outs, Lay-Off, Retrenchment, And closure.
• Form- I contains the Memorandum of settlement arrived at during conciliation/ or settlement arrived at between the employer and his workers otherwise than in the course of conciliation Proceeding
• Form- II contains the Application for Registration of Trade Union
• Form III lays down the form of the Register of Trade Unions
Objection and suggestion, if any, in respect to the draft shall be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Official Gazette in which this draft of rules is published are made available to the public.
