The Petroleum and Explosives Safety Organisation (PESO) on June 07, 2023, issued a notification regarding the Withdrawal of Indian representatives/distributors for importing gas cylinders/ valves/ regulators from foreign manufacturers.
The following has been stated namely: -
• The design drawings for gas cylinders of foreign gas cylinder manufacturers have been approved by PESO as per the provisions laid down under Rule 3 of Gas cylinder rules, 2016.
• The foreign manufacturers while seeking approval submit the requisite documents along with the name of the Indian distributor appointed by them to import their cylinders from the country of origin and to market in India.
• The name of the distributor referred by the manufacturer is recorded to monitor the movement of the imported cylinders in India as well as for fixing accountability and traceability in case of any untoward incident occurs.
• The selection/identification and appointment of the Indian distributor comes under the purview of the foreign cylinder manufacturer only and PESO has no role in the selection of the Indian distributor. The same procedure is followed in recording an additional distributor referred by the foreign cylinder manufacturer.
• An Indian distributor recently, has alleged that PESO has not obtained his consent while recording the second distributor name referred by the foreign manufacturer, and the same was brought to the notice of higher dignitaries/authorities.
• Based on the aforesaid a Show Cause within thirty days has been requested from June 07, 2023, as to why appropriate action, as deemed fit, should not be initiated against the persons/firms/companies who are creating conflict.
• Annexure 5 with the Approval Granted to Foreign Manufacturers for Manufacturing of Cylinders/Valve by Peso has been attached
