The Government of Himachal Pradesh on June 19, 2023, issued the draft of Himachal Pradesh Town and Country Planning Tenth (Amendment) Rules, 2023 to further amend the Himachal Pradesh Town and Country Planning Rules, 2014.
The following amendments have been stated:
• For Appendix-9, appended to the Himachal Pradesh Town and Country Planning Rules, 2014 the following shall be substituted, namely: -
“Appendix 9 Regulations for The Installation of Communication Towers
1. The Policy communicated by the Department of Information Technology, Himachal Pradesh shall be applicable in all the Planning Areas and Special Areas in the State of Himachal Pradesh subject to the condition that minimum setbacks as applicable for residential buildings in that Planning Area or Special Area shall be applicable, in case tower is installed on ground. A Structural Stability Certificate of the building shall be mandatory for rooftop towers and towers erected on the ground.
2. In–building solutions for digital communications infrastructure shall be made as per provisions in an addendum to Model Building Bye-Laws, 2016, and subsequent amendments from time to time which shall apply to all commercial, residential (including residential Cooperative Societies buildings), official buildings (including Government buildings), Multi-storey commercial buildings, Government/Private Hospitals, Commercial Complexes/Hotels (Including Home Stays/Bed and Breakfast (B&B)/Airports/Police Buildings etcetera located in Planning/ Special Areas constituted under the provisions of Himachal Pradesh Town and Country Planning Act, 1977 and to those Real Estate Projects which require registration with Real Estate Regulatory Authority (RERA), Himachal Pradesh.”
If any person, likely to be affected by these draft rules has any objection(s) or suggestion(s) against these draft rules, he/she may send the written objection(s) or suggestion(s) to the Principal Secretary (TCP) to the Government of Himachal Pradesh, Shimla within a period of 30 (thirty) days from the date of publication of the said draft rules in the Rajpatra (e- Gazette), Himachal Pradesh.
