BSE issued a notification regarding the Implementation of the Security Council Resolution on Democratic People ‘s Republic of Korea (Amendment) Order, 2021: Updates to UNSC’s 1718 Sanctions List of Designated Individuals and Entities

Secretarial ComplianceThe Bombay Stock Exchange (BSE) on July 04, 2023, issued a notification regarding the Implementation of the Security Council Resolution on Democratic People‘s Republic of Korea (Amendment) Order, 2021: Updates to UNSC’s 1718 Sanctions List of Designated Individuals and Entities 

The following has been stated namely: -

• This has a reference to the following notifications issued by the United Nations Security Council (UNSC) Committee namely: -

(i) Note SC/15342 dated June 30, 2023 (Annexure 1) regarding the amendment in 16 entries, details are mentioned in the attachment, in UNSC’s 1718 Sanctions List of Designated Individuals and Entities.

(ii) The UNSC press releases concerning the list of amended entries are available at the URL: https://press.un.org/en/2023/sc15342.doc.htm

(iii) Press releases concerning changes to the Committee’s Sanctions List may be found in the “Press Releases” section on the Committee’s website at the following URLs namely: -

(a) https://www.un.org/securitycouncil/sanctions/1718/press-releases

(b) https://www.un.org/securitycouncil/sanctions/1718/materials

•  It states that the updates regarding amendments made to UNSC Sanctions List are also available on the SEBI website under “Media” in a separate tab “UNSC Sanctions Committee List”

• It is advised to

 a. To follow the procedure as mentioned in the Ministry of External Affairs, Government of India’s order CG-DL-E-23032021-226038, dated March 22, 2021, detailing the Implementation of Security Council Resolution on Democratic People‘s Republic of Korea under the United Nations (Security Council) Act, 1947.

 b. Scan all existing accounts to ensure that no account is held by or linked to any of the entities or individuals included in the list and also ascertain the same for future accounts as well (as per clause 51 of SEBI “Guidelines on Anti-Money Laundering (AML) Standards and Combating the Financing of Terrorism (CFT) / Obligations of Securities Market Intermediaries under the Prevention of Money Laundering Act, 2002 and Rules framed there under”) dated February 03, 2023.

• The members are further advised to take note of the above and comply
