The Government of Madhya Pradesh on July 12, 2023, published the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce Production, Supply and Distribution) Madhya Pradesh Amendment Bill 2023
The following has been stated namely: -
• In Section 3 which states “Definitions” the following shall be inserted namely: -
(i) After clause (c) the following shall be inserted namely: -
"(c)(i) Establishment – means a residential hotel, restaurant, eating house, or other public amusement or entertainment and includes such other establishment of such nature as the State Government may by notification maintain”
(ii) After clause (e) the following shall be inserted namely: -
(e)(i) “Hookah Bar” means a place where people smoke tobacco from a community hookah assembled to smoke from other similar products which may be used singly or jointly”
• In the Section 4 which states “Prohibition of smoking in Public places” the following clause shall be added namely: -
“(4)(k) notwithstanding anything contained in this Act, no person shall either by himself or on behalf of any other person, open or run a hookah bar at any place including eatery
Provided that for the purpose of this section, the word “eating house” means a place where food or refreshment of any kind is provided to visitors or sold for consumption therein”
• In Section 12 which states “Power of Entry and Search” in sub-section (1) in clause (b) for the full stop the words “or” shall be substituted and thereafter the following new clause shall be inserted namely: -
“(c) where a hookah bar is being run”
