The Ministry of Power (MoP) on July 05, 2023, notified the Electricity (Amendment) Rules, 2023, further to amend the Electricity Rules, 2005.
The following has been amended namely: -
•In Rule 3 which talks about the requirements of Captive Generating Plant in clause (a), sub-clause (i) has been substituted.
•Rule 4A has been added which states that where any entity has been granted a license under section 14 of the Electricity Act, the period of the license shall be in accordance with the terms and conditions of the license granted by the Appropriate Commission.
•Rule 4B has been added which states that where an entity is a deemed licensee under the first, second, and fifth proviso to section 14 of the Act, the period of the license shall be twenty-five years from the date of the Act's coming into force.
•Rule 4C has been added which states that the license granted by the Appropriate Commission under section 14 of the Act and the deemed license under the first, second, and fifth proviso to said section 14 shall be deemed to be renewed unless revoked.
They shall come into force on the date of their publication in the Official Gazette.
