Commercial ComplianceThe Government of Haryana on July 27, 2023, issued a draft notification regarding the modification of the Stage Carriage Scheme, 2016

All routes and locations are serviced only by the State Transport Undertaking of Haryana for stage carriage transport, with the exception of a few intra-State routes that were allocated to private operators under the Stage Carriage Scheme, 2016.

The said scheme needs to be modified in the public interest keeping in view the following objectives, namely: - 

• Provide adequate public transport services to passengers in all areas of the State; 

• ensure the safety of passengers; and 

• adopting a fair and transparent criterion for the allocation of stage carriage permit

The following amendment has been stated:

• In para 2, for clause (i), the following clause shall be substituted, namely: - 

“(i) The stage carriage permits on the routes and area mentioned in the Schedule shall be granted to the State Transport Undertaking or any person, society, firm or company in the State.”.

• For para 3, the following para shall be substituted, namely: - 

“3. Notwithstanding anything contained in this scheme, the permits issued under the City Bus Service Scheme, 2004 shall remain valid and operative as per the terms and conditions of the said scheme.”

• After para 3, the following paras shall be added, namely; 

“4. No stage carriage bus shall be allowed to ply unless it is equipped with or fitted with a vehicle location tracking device and one or more emergency buttons as per the provisions of rule 125H of Central Motor Vehicles Rules, 1989 and all the existing permit holders shall, within a period of thirty days from the date of publication of final notification in the Official Gazette get their vehicle equipped with or fitted with vehicle location tracking device and one or more emergency buttons. 

5. The movement of the stage carriage on all the village roads, rural roads, and other district roads shall not be covered under this scheme and shall be regulated as per the provisions of Chapter V of the Motor Vehicles Act, 1988, and as per the terms and conditions laid down by the State Government for the grant of stage carriage permits on such routes. 

Explanation. - For the purposes of this para, “village roads”, “rural roads” and “other district roads” shall mean the roads other than the national highways, state highways, and major district roads.”.

• The existing Schedule has been amended.

The proposal of the modified draft scheme shall be taken into consideration by the State Government on or after the expiry of a period of thirty days from the date of publication of this notification in the Official Gazette, together with objections or suggestions, if any, which may be received by the Principal Secretary to Government, Haryana, Transport Department, Chandigarh through email on [email protected] or by post from any person with respect to the modified draft scheme before the expiry of the period so specified.
