The Ministry of Labour & Employment (MoL&E) on July 31, 2023, issued a notification regarding the Social Security Benefits to Gig Workers.
The four labour laws aim to increase the protections offered to workers, even those who are not organised, in terms of the legal minimum wage, social security, and health care. The labour codes define terms like "employee," "worker," "gig worker," "platform worker," "unorganised worker," "home-based worker," "contract labour," "inter-state migrant worker," "building worker," "wage worker," "motor transport worker," "audio-visual worker," etc. The labour codes aim to cover all forms of employment, including traditional and non-traditional forms of employment.
The Code on Social Security, 2020 calls for the development of appropriate social security plans for gig and platform employees in areas such as life and disability insurance, accident insurance, health and maternity benefits, old age protection, and so on. The Code also provides for the establishment of a Social Security Fund, with contributions from aggregators ranging from 1 to 2% of an aggregator's yearly sales, subject to a maximum of 5% of the amount paid or payable by an aggregator to such workers.
