Industry Specific ComplianceThe Department of Telecommunications (DoT) on August 03, 2023, notified regarding the charging of interest rates on delayed payment of the penalty imposed in CAF audits & EMF matters and on testing fees charged for EMF audit & MNP testing.

This is in reference to the various guidelines that the DoT has issued from time to time regarding Subscriber Verification, EMF radiation, and Mobile Number Portability; in particular, guidelines issued on December 12, 2011, where it was specified, among other things, that interest at a rate of 2% over the SBI's PLR would be charged for any delay in the payment of penalties imposed for non-compliance found during the CAF audit process.

The following has been amended:

• That Para 1 (a) (ii) of instructions dated December 12, 2011 stands deleted.

• That henceforth clause 20.5 of UASL, 20.6 of UL(VNO), and 20.7 of UL. amended as of October 01, 2021, shall be applicable for any delay in payment of demands raised by DoT/LSAS for the following:

o Imposition of penalty due to violation of instructions issued regarding Subscriber Verification (CAF audit) & EMF radiation matter. 

o Charging of EMF audit testing fees & MNP testing fees.
