The Labour Department, GNCTD on July 31, 2023, issued a notification clarifying the registration of Trade Union/Federation of Trade Union having all India Jurisdiction by Registrar Trade Union Delhi.
The Ministry of Labour & Employment vide letter dated July 07, 2023, has informed as under:-
(a). As per section 2 of the Trade Unions Act, 1926 "The appropriate Government means, in relation to Trade Unions whose object is not confined to one state, the Central government, and in relation to other Trade Unions, the State Government"
(b). As per Gazette Notification under the Indian Union Act 1926. Ministry of Labour & Employment has also forwarded a copy of the notification dated January 23, 1962. A copy of a letter dated 07.07.2023 and notification dated January 23, 1962, is enclosed for reference.
The appropriate action is to be taken in respect of the registration of Trade Union and Federation of Trade Union having all India Jurisdiction by Registrar Trade Union Delhi, in the light of clarification of Ministry of Labour & Employment.
