The Director General of Civil Aviation (DGCA) on August 04, 2023, issued the notification regarding the Requirements for approval of design data for modification and repairs under Rule 52 of the Aircraft Rules, 1937.
The following has been stated namely: -
• Rule 52 of the Aircraft Rules, 1937 states about Modification and repairs. This Civil Aviation Requirements (CAR) prescribes the requirements to be followed by an Indian owner/operator for obtaining approval of design data for modification or repair on aircraft, aircraft components, or items of equipment of that aircraft from DGCA.
• This is applicable to all Indian owners or operators intending to carry out modification or repair in respect of any aircraft registered in India, in case the design data in respect of the modification or repair is not approved by the State of Design or the data certified by Authorized Representative (AR)/ Designated Engineering Representative (DER) of the State of Design of the aircraft.
• The definitions of terms such as Aeronautical product, Item of equipment, Major Modification, etc. have been stated.
• The requirements are stated namely: -
1. An applicant seeking approval of major modification shall comply with the requirements outlined in CAR 21 Subpart E and its associated AMC/GM
2. DGCA may impose additional special conditions if it finds it necessary to establish a level of safety equal to that established by the type-certification basis incorporated by reference in the type-certificate.
3. DGCA as State of Design of the modification shall transmit the mandatory continuing airworthiness information to all States that have the modified aircraft on their registries
• The Issue/Cancellation approval of minor modification/repair design has been stated –
1. Upon being satisfied, DGCA may grant approval for minor modification/ repair design, which shall be communicated to the applicant along with additional conditions, if any.
2. If at any point in time, the DGCA finds that there is a reasonable doubt, the DGCA may cancel the approval for minor modification/repair design.
