Industry Specific ComplianceThe Department of Telecommunications (DoT) on August 21, 2023, issued an amendment to ILD Licensees (other than UL) for restriction to enter an exclusive contract with any public entity or any person.

The following amendment has been stated:

• In condition 24, new condition 24.5 has been inserted:

24.5 License shall not enter into any exclusive contract for establishing a public network to provide public telecom services or Right of Way (ROW) with any Public entity or any Person.

• In Annexure-I: Definitions and Interpretations, the following has been inserted:

53 "Person" shall include an individual, any company or association or body of individuals, whether incorporated or not, by whatsoever name called or referred to;

54 "Public entity" means (a) the Central Government, (b) State Governments, (c) local authority, (d) any authority, body, company or institution incorporated or established by the Central Government or the State Government, or under any statute, or (e) any non-government entity vested with the ownership, control or management of any public facility or class of public facilities, as notified by the Central Government.
