Finance & Taxation ComplianceThe Directorate General of Trade Remedies (DGTR) on September 29, 2023, issued a notification regarding the Anti-dumping investigation concerning imports of " Metronidazole” originating in or exported from China PR.

The following has been stated: -

•The product under consideration is “metronidazole” originating in or exported from China PR.

•The product is used in treatment of bacterial infections and parasitic infections. It is used in cases of amoebiasis [amoebic dysentery], trichomoniasis [STD], giardiasis [beaver fever], gingivitis [gum inflammation], acute ulcerative, anaerobic vaginosis [vaginal inflammation] caused by overgrowth of natural bacterial found in the tracts.

•The volume of imports has declined from the base year as compared to the POI. There is an increase in imports during the POI as compared to the previous year, however, imports in relation to the Indian production and the total demand has declined as compared to the base year.

•The price undercutting and price suppression/depression throughout the entire examined period, except the second half of the POI is negative. However, during the second half of the POI, the price of raw materials has substantially increased, which has contributed to the significant increase in cost of production of the applicant, and consequently, the positive price undercutting and price suppression/depression during this period.

•The subject goods exported from the subject countries and the article manufactured by the domestic industry are ‘like article’ to each other in terms of Rule 2 (d) of the AD Rules, 1995.

•Indian industry issues: The Authority notes that the subject good is an active pharmaceutical ingredient, which is used to manufacture a drug that has been listed in the ‘National List of Essential Medicines’ by the Department of Pharmaceuticals, Ministry of Chemicals and Fertilizers. Further, Metronidazole medicine has been subject to several price control orders by the National Pharmaceutical Pricing Authority of India.

•An appeal against this notification shall lie before the Customs, Excise and Services Tax Appellate Tribunal in accordance with the Customs Tariff Act, 1975.
