The Government of Punjab on October 19, 2023, issued the Registration (Punjab Amendment) Act, 2023 to further amend the Registration Act, 1908.
The following amendments have been stated:
• In section 17, which states “Documents of which registration is compulsory”:
(i) In sub-section (1), after clause (e), the following clause has been added, namely:
"(f) any certificate of sale granted to the purchaser of any property sold by public auction by a Civil or Revenue Officer or Civil Court or any authority, under law.";
(ii) After sub-section (1A), the following sub-section has been inserted, namely:
"(1B) Notwithstanding anything contained in section 59 of the Transfer of Property Act, 1882 (4 of 1882), any instrument or agreement relating to the deposit of title deeds (Equitable Mortgage), where such deposit has been made by way of security for the repayment of a loan or an existing or future debt, shall be registered."; and
(iii) In sub-section (2), clause (xii) has been omitted.
This notification will come into force from October 19, 2023.
