The Ministry of Agriculture and Farmers Welfare (MoA&FW) on October 26, 2023, issued the Insecticides (Fifth Amendment) Rules, 2023 to further amend the Insecticides Rules, 1971.
The following amendment has been stated:
• In rule 14, which states “Transfer of license” in sub-rule(1), the following provisos, have been inserted namely:
“Provided that in case of death of the existing retailer or dealer, the family member of the deceased retailer or dealer, during the currency of the license, may apply for permission to transfer the license in his name subject to the submission of the death certificate of the deceased dealer or retailer and the legal heir certificate before the concerned licensing officer:
Provide further that the family member of the deceased retailer or dealer who is without the qualifications referred to in rule 10 shall undergo the certificate course in insecticides management for transfer of license and such license shall be provisionally transferred to the family member for a period of one year or till the family member completes the certificate course in insecticides management, whichever is earlier and during the said period, the applicant may employ a person with such educational qualifications referred to in rule 10.”
This notification will come into force from October 26, 2023.
