The Government of Himachal Pradesh on December 05, 2023, issued the Draft Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Rules, 2023.
The following provisions have been stated:
• Application under section 12, which states “Alienation of immovable properties of the public religious institution and charitable endowment”, seeking transfer of land:
The application seeking permission for the transfer of immovable property belonging to, or given or endowed for any Hindu Public Religious Institution and Charitable Endowments by way of exchange, sale, mortgage, or in any other manner whatsoever or for the lease of any such property shall be in Form 'C'.
• Alienation of Gold and Silver under section 12-A, which states “Alienation of gold and silver of Hindu Public Religious Institutions and Charitable Endowments”:
The offerings received from the devotees in the shape of various varieties of gold and silver in every Hindu Public Religious Institution and Charitable Endowments, as included in Schedule-I of the Act, shall be alienated in the manner, as may be recommended by the Temple Trust subject to the prior approval of the Government.
Objection(s) or suggestion(s), if any, shall be considered by the Government of Himachal Pradesh within the expiry of 30 days from December 05, 2023, and may send the written objection(s) or suggestion(s) to the Secretary (LAC) to the Government of Himachal Pradesh, Armsdale Building, Shimla-2.
This notification will come into force from December 05, 2023.
