The Himachal Pradesh Electricity Regulatory Commission (HPERC) on December 14, 2023, issued the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2023.
The following provisions have been stated:
• Appointment of Secretary, Officers, and Employees of the Commission:
(1) The Commission may have a secretary, and Officers and other employees for discharging various duties. It may also specify qualifications, experience and other terms and conditions for the appointment of Secretary, Officer, and other employees in conformity with the provisions of the Act and Regulations made thereunder.
(2) The appointment of the Secretary, Officers and other employees of the Commission shall, unless otherwise directed by the Commission, be made by the Chairperson.
(3) The Chairperson may appoint Consultants to assist the Commission in the discharge of its functions.
• Decision to be by majority:
If the Bench of the Commission consists of two Members and differ in opinion on any point, they shall state the point or points on which they differ, and refer to the Chairperson, who shall either hear the point or points himself or refer the case for hearing on such point or points by one or more of the other Members of the Commission and such point or points shall be decided according to the opinion of the majority of the Members of the Commission, who have heard the case including those who first heard it, but in such cases the Chairperson or the Member presiding over a bench shall not exercise a second or casting vote.
The objections or suggestions on this behalf will be considered after the expiry of 15 days from December 14, 2023, and should be addressed to the Secretary, Himachal Pradesh Electricity Regulatory Commission, Vidyut Aayog Bhawan, Block No.-37, SDA Complex Kasumpti, Shimla-171009.
