Industry Specific ComplianceThe Home Department, Maharashtra on January 09, 2024, issued Bombay Foreign Liquor (Amendment) Rules, 2024 to further amend the Bombay Foreign Liquor Rules, 1953.

The following has been stated namely: -

• Rule 40 which states “Regulation of business of licensee” the clause (al) has been inserted after sub-rule (2): -

"Subject to the provisions of clause (b), a holder of vendor's license, may carry on his business under the license, by making an agreement with any person being his agent with the previous sanction of the licensing authority, on payment of fees prescribed under the Bombay Prohibition (Privileges Fees) Rules, 1954. Such agreement shall be for conducting business on behalf of vendor as per rules, regulations, terms, conditions, orders, etc. issued by the State Government, from time to time and it shall not confer upon such agent any legal status of a partner or a licensee of the said license.".

• In Form FL-II appended to the principal Rules,

i. In condition No. 6, after the words "the licensee" the words "and the agent of the said license, if any," shall be inserted

ii. In condition No. 7, after the words "the licensee" the words "and the agent of the said license, if any," shall be inserted”
