The Parliament on January 19, 2024, issued the Consumer Protection (Amendment) Bill, 2023, to further amend the Consumer Protection Act, 2019.
The following amendments have been stated:
• Section 89, which states “Punishment for false or misleading advertisement” has been substituted:
"89. Any manufacturer, service provider, advertiser, advertising agency or endorser who causes a false misleading or surrogate advertisement to be made that is prejudicial to the interest of consumers shall be punished with imprisonment for a term which may extend to 2 years and with a fine which may extend to 10 lakh rupees; and for every subsequent offence, be punished with imprisonment for a term which may extend to 5 years and with fine which may extend to 50 lakh rupees."
