The Central Government on February 02, 2024, notified the Indian Contract (Amendment) Bill, 2024 to further amend the Indian Contract Act, 1872.
The following has been stated-
•Section 15 of the Indian Contract Act, 1872 that is Coercion is amended.
The current definition of "any act forbidden by the Indian Penal Code" is problematic due to the repeal of the Indian Penal Code (1860) and its replacement by the Bharatiya Nyaya Sanhita (2023). The purpose of the Indian Penal Code was to create offences, not merely forbid them. Additionally, other laws besides the Bharatiya Nyaya Sanhita serve the same function of defining and punishing offences. This has led to inconsistencies in interpretation among different courts. Therefore, the definition needs to be revised to encompass all offences forbidden by law in India, ensuring clarity and consistency in legal interpretation.
