The Parliament on February 07, 2024, issued the Jammu and Kashmir Local Bodies Laws (Amendment) Act, 2024, to further amend the Jammu and Kashmir Panchayati Raj Act, 1989, the Jammu and Kashmir Municipal Act, 2000 and the Jammu and Kashmir Municipal Corporation Act, 2000.
The following amendments have been stated under the Jammu and Kashmir Panchayati Raj Act, 1989:
• For section 36B, which states “Removal of State Election Commissioner”, the following section shall be substituted, namely:
"36B. The State Election Commissioner shall not be removed from his office except in like manner and on the like ground as a Judge of a High Court and the conditions of service of the State Election Commissioner shall not be varied to his disadvantage after his appointment.".
The following amendments have been stated under the Jammu and Kashmir Municipal Act, 2000:
• After section 282, which states “Chief Electoral Officer”, the following section shall be inserted, namely:
"282A. Sections 36, 36A, 36B, 36C, 37 and section 39 of the Panchayati Raj Act [as amended by the Jammu and Kashmir Local Bodies Laws (Amendment) Act, 2024] shall, mutatis mutandis, apply to this Act.".
The following amendments have been stated under the Jammu and Kashmir Municipal Corporation Act, 2000:
• After section 9, which states “Election to the Corporation”, the following section shall be inserted, namely:
"9A. Sections 36, 36A, 36B, 36C, 37 and section 39 of the Panchayati Raj Act and sub-section (2) of section 282 of the Municipal Act [ as amended by the Jammu and Kashmir Local Bodies Laws (Amendment) Act, 2024] shall, mutatis mutandis, apply to this Act.".
This notification will come into force from February 12, 2024.
