Industry Specific ComplianceThe Government of Karnataka on February 15, 2024, issued the Karnataka Co-Operative Societies (Amendment) Bill, 2024 to further amend the Karnataka Co-operative Societies Act, 1959.

The following amendments have been stated:

• In Section 21 which states Manner of exercising vote, in sub-section (3), before Explanation, the following has been inserted, namely:- 

“(4) Notwithstanding anything contained in this Act or Bye-laws, in the Election of the Board of Secondary Co-operative Societies or Federal Co-operative Societies or Apex Co-operative Societies to the reserved seats, irrespective of any class of voters of the said societies, they shall be entitled to exercise their votes, in the manner as may be prescribed.”

• In section 63 which states Audit, after subsection (1), before the first proviso, the following shall be inserted, namely: - 

“Notwithstanding anything contained in sub-section (1), except urban cooperative banks once in every three years every co-operative society shall get its accounts audited by the Auditor of Co-operative Audit Department.”

• Section 98G has been substituted, namely:-

“98G. Restriction on a number of Government Nominees. - Where the society is an assisted society as specified in clause (a-1-1) of section 2 there shall be three nominees of the State Government in the board of the State Cooperative Bank or the Central Cooperative Bank or a primary Agricultural Credit Cooperative Society or the State Agriculture and Rural Development Bank or an Agriculture and Rural Development Bank.” 

It shall come into force at once.
