The Government of Gujarat on February 15, 2024, issued a notification regarding ensuring compliance with labor laws while employing employees/ labourers through outsourcing/contract methods.
The following has been stated: -
•The following details shall be ensured before employing/extending employees/laborers through outsourcing/contract methods by various departments/Heads of Accounts/Subordinate Offices/Boards/Corporations/Corporations of the Government.
1. The contractor/outsourcing agency concerned should be registered under the Provident Fund and Miscellaneous Provisions Act, 1952 as applicable.
2. In areas covered under the Workers' State Insurance Act, 1948, the concerned contractor/outsourcing agency should be registered under the Workers' State Insurance Act, 1948.
3. The principal employer/outsourced supplier concerned contractor/outsourcing agency should have obtained registration and license under the Contract Labor (Regulation and Abolition) Act, 1970. If applicable, last year's return (Consolidated Annual Return - CAR) should be filled.
4. In the case of labourers/employees employed in other ongoing works of the concerned contractor/outsourcing agency, EPF/ESI contribution should be paid regularly and the EFP Portal extract should be submitted to ensure the same.
•After issuing the work order to the contractor/outsourcing agency when the bill is presented by the concerned contractor/outsourcing agency, the following details are to be ensured.
1. To verify that the labourers/employees engaged through the contractor/outsourcing agency are issued with the respective month's pay slip and the salary is paid directly into the bank account.
2. EPF/ESI contribution collected from various Govt. Departments/Heads of Accounts/Subordinate Offices/Boards/Corporations/Corporations deposited in the EPF/ESI account of the concerned employee shall have access to the contribution of EPF/ESI.
3. In case the labourers/employees are made to work for more than eight hours in a day, overtime wages shall be paid at double the normal rate of wages.
