The Government of Maharashtra on March 14, 2024, issued the Bombay Prevention of Fragmentation and Consolidation of Holdings (Amendment) Rules, 2024, to further amend the Bombay Prevention of Fragmentation and Consolidation of Holdings Rules, 1959.
The following has been amended namely: -
• In rule 2 which states “Definitions” two new definition clauses have been inserted, clause (a-1) defines “farm road” and clause (c-1) defines “well”.
• In rule 27 which states “Application for Permission of Transfer of consolidated holding of any land and conditions for such transfer”, a new sub-rule 2 (1) has been added which states about the sanction of holdings of the land for farm roads, wells, and for Central or State Rural Housing Policy Scheme.
• In rule 27, sub-rules 2A, 2B, and 2D which state that for farm roads, wells, and Central or State Rural Housing Policy Scheme, an Application shall be made in FORM XII - “Application to Transfer Land for Well or Road or House under Rural Housing Scheme”.
• In rule 27, sub-rule 2E, has specified that the sanction of the Collector for such transfers shall be valid only for one year which can further extend to two years by a request from the applicant.
