The Government of Maharashtra on March 18, 2024, issued the Maharashtra Co-operative Societies (Second Amendment) Act, 2024, to further amend the Maharashtra Co-operative Societies Act, 1960.
This shall come into force on March 18, 2024.
The following have been amended namely: -
• It mentions that a new Section 69A has been inserted, which states the constitution of the “Co-operative District Cadre of Secretaries”.
• It specifies that a district supervision cooperative society shall establish the “Cooperative District Cadre Employment Fund” for expenses related to salaries, allowances, and other emoluments of personnel, and cadre-related expenditures.
• It states that the state government shall establish rules governing the custody, maintenance, payment, expenditure, and withdrawal of funds from the said fund.
• In section 88 (1) which states that upon audit, inquiry, inspection, or society winding up, if the Registrar finds misappropriation or breach of trust within five years, charges may be framed, and individuals are allowed to respond before being ordered to repay or compensate for misdeeds, the words “within a period of two years” shall be substituted by the word “within a period of one year”.
